South African Police Service | Western Cape | NARI

10 Mar 2018, Atlantis, Cape Town: On 20 November 2016 at about 03:30, the 26 year old accused, Aviwe Mgungubali, was approached by a 15 year old youth who asked him for a cigarette while he was busy on his cell phone.

As the youngster persisted in asking the accused for a cigarette, the accused got upset, took a knife out of his pocket and stabbed the young man in the chest.

The victim was taken to Wesfleur hospital and later died from his injuries.

The accused entered into a plea bargain with the state and admitted to stabbing the deceased during the early morning hours in Witsand.

The detective in partnership with the Senior State Prosecutor and the deceased's family agreed on the plea and the sentence of 10 years imprisonment.

During the investigation period it was noted that the accused, Mr Aviwe Mgungubali, was a licenced firearm holder, but he had to be declared unfit to possess a firearm due to the seriousness of the crime he committed.

SAPS management in the province are pleased with the sentence. #Sentencing
